Terms and Conditions

By accessing or using Xgrowkit("Service", "we", "us", "our") at https://xgrowkit.com and https://app.xgrowkit.com, you agree to these Terms and Conditions and our Privacy Policy. These terms apply to all visitors, users, and others who access or use the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Xgrowkit is an AI-powered growth tool for X (Twitter) that provides:

• AI-generated content drafts based on your personal voice profile
• Scheduled posting to your connected X account
• Content inspiration sourced from your niche
• Growth analytics and engagement tracking
• Waitlist registration for early access

The Service is currently in pre-launch. Features described are subject to change before and after public launch. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Provide truthful and current registration information
• Maintain the security of your password
• Notify us immediately of any unauthorized account access
• Not share your account with any third party
• Not create more than one account per person

We reserve the right to terminate accounts, remove content, or cancel subscriptions at our discretion, including for violation of these Terms.

Xgrowkit connects to your X account via OAuth 2.0. By connecting your X account, you authorize us to:

• Read your recent posts to build your voice profile
• Publish posts to your X account on your behalf
• Read basic analytics associated with your posts

We request only the minimum permissions required for these functions. We do not request access to your direct messages, follower/following lists, or account settings beyond what is necessary for the Service.

You may revoke our access at any time via your X account settings under "Connected Apps". Revoking access will disable scheduling and analytics features but will not delete your Xgrowkit account data unless you explicitly request deletion.

Your use of X through our Service is also subject to X's own Terms of Service and Developer Agreement. You are responsible for ensuring your use of Xgrowkitcomplies with X's policies, including their rules on automation and spam.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Publish spam, misleading, or deceptive content
• Harass, abuse, or harm other users or third parties
• Infringe any intellectual property rights
• Publish content that violates X's Terms of Service
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any commercial resale without prior written consent
• Create fake accounts or impersonate other individuals
• Engage in coordinated inauthentic behavior on X

Violation of these terms may result in immediate termination of your account without notice or refund.

Xgrowkit uses artificial intelligence to generate content drafts based on your voice profile. You acknowledge and agree that:

• All AI-generated content requires your review and approval before publishing. Nothing is published without your explicit action.
• You are solely responsible for any content published to your X account through our Service, including AI-generated content you approve.
• AI-generated content may occasionally be inaccurate, inappropriate, or not reflective of your intended message. Always review drafts carefully.
• We do not guarantee that AI-generated content will achieve any specific growth outcomes, engagement rates, or follower counts.
• You grant us a limited license to use your post history solely for the purpose of generating your voice profile and content suggestions.

Xgrowkit offers paid subscriptions. By subscribing, you agree to the following:

• Billing: Subscriptions are billed monthly or annually in advance. Payments are processed securely through our payment provider (Polar.sh).
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Early Bird pricing: Early bird pricing is locked in for as long as the subscription remains active. Cancelling and resubscribing forfeits the early bird rate.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Refunds: We offer a 7-day money-back guarantee for first-time subscribers. After 7 days, all charges are non-refundable unless required by applicable law.
• Price changes:We reserve the right to change subscription prices with 30 days' notice. Early bird pricing is exempt from price increases for active subscribers.

Joining the Xgrowkit waitlist does not create a contractual obligation on either party. Waitlist signups:

• Do not guarantee access to the Service or any specific features
• Do not require payment or credit card information
• Will receive one launch notification email when the Service becomes available
• May unsubscribe at any time by contacting hello@xgrowkit.com

Early bird pricing reserved for waitlist signups is subject to availability (first 10 signups) and may change before launch.

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Xgrowkit and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

You retain ownership of all content you create and publish through the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide the Service to you.

We take the security of your data seriously. Xgrowkit implements the following security measures:

• AES-256-GCM encryption for all sensitive data at rest, including OAuth tokens and credentials
• Secure HTTPS connections for all data in transit
• Minimum necessary data collection and storage
• No storage of X passwords — authentication is handled via OAuth 2.0
• Regular security reviews and updates

Despite these measures, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your data. In the event of a data breach, we will notify affected users as required by applicable law.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any content generated by the Service will be accurate, complete, or suitable for your specific purposes.

To the maximum extent permitted by law, Xgrowkit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Actions taken by X or changes to X's platform or API

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

Xgrowkit integrates with or relies on third-party services including X (Twitter), Supabase, Resend, and Polar.sh. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration.
